Kretschmar ® "SUPER SAVINGS. LEGENDARY TASTE." SWEEPSTAKES (“Sweepstakes”) OFFICIAL RULES AND REGULATIONS (“Official Rules”)
NO PURCHASE NECESSARY TO ENTER OR WIN.

1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. To enter the Kretschmar® "Super Savings. Legendary Taste." Sweepstakes (the “Sweepstakes”), you must be a legal resident of the fifty (50) United States or the District of Columbia and be 18 years of age or older as of December 15, 2007.

2. ENTRY METHOD: Anytime from December 15, 2007 12:01 AM (ET) through February 15, 2008 11:59 PM (ET) (“Promotional Period”), i) you may enter the Sweepstakes by hand printing your name, complete address, including street, city, and zip code and home telephone number including area code, and date of birth on an official entry form found at participating retailers or on a 3” x 5” card and mailing your entry in a stamped business size #10 envelope to: Kretschmar® "Super Savings. Legendary Taste." Sweepstakes, P.O. Box 14789, Cincinnati, OH 45250 or ii) you may visit www.kretschmardeli.com and complete the online entry form.  Each mail in entry must be postmarked by February 15, 2008 and received by Sponsor no later than February 22, 2008 to be eligible. Limit one (1) entry per person regardless of entry method. John Morrell & Co., (“Sponsor”) and its agencies are not responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, mutilated, or postage due mail. Photocopies, mechanically reproduced, forged or altered mailed entries and facsimiles are void. Incomplete or illegible entries are not eligible. All entries automatically become the property of the Sponsor and will not be returned or acknowledged.

3. EIGHT (8) GRAND PRIZE PACKAGES AND APPROXIMATE RETAIL VALUES:  Each Grand Prize award consists of: one (1) $1,500.00 Best Buy Gift Card, expiration date March 17, 2009. The approximate retail value of each Grand Prize is $1,500.00.  Total ARV of the eight (8) Grand Prize awards is $12,000.00.

4. WINNERS: Winner will be determined in a random drawing by an independent panel on or about February 27, 2008, from all eligible entries received by Sponsor and decision of judges is final. Odds of winning are dependent upon the number of all eligible entries received by Sponsor for each region, with up to but no more than two winners per region. Entrants must comply with these Official Rules. Potential Grand Prize winners will be notified by USPS priority mail with delivery confirmation.  Potential winners will be required to complete, sign and return, a notarized Affidavit of Eligibility/Release of Liability and Publicity Release (where legal) before any prize is awarded.  Potential winners are required to return such documents to Sponsor within 14 days from the postmark date on the prize notification letter. Failure to comply with this requirement or return of a prize notification as undeliverable or failure to comply with the Official Rules (or any portion of them) will result in forfeiture of the prize and an alternate potential winner shall be selected from all remaining eligible entries. All prize details are at Sponsor's discretion.

5. ELIGIBILITY: The Sweepstakes is only open to legal residents of the fifty (50) United States or the District of Columbia from the following six geographic regions: Northwest, West Coast, Midwest, Southwest, Northeast, and Southeast who are 18 years of age or older as of December 15, 2007. Employees, officers, directors and agents of John Morrell & Co. and their respective companies, parents, subsidiaries, affiliates, retailers, advertising and promotional agencies or any of the members of their immediate family (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) or members of the same household of each are not eligible to enter the Sweepstakes. This Sweepstakes is void where prohibited or restricted by law, and is subject to all applicable federal, state and local laws. 

6. ENTRANTS BY THEIR PARTICIPATION AGREE TO INDEMNIFY AND HOLD HARMLESS THE SPONSOR AND ITS AFFILIATES FROM ANY AND ALL CLAIMS AND LIABILITIES AND WAIVE ANY AND ALL CLAIMS OF LIABILITY OF ANY KIND WHATSOEVER AGAINST THE SPONSOR AND THE ITS AFFILIATES, INCLUDING WITHOUT LIMITATION ANY PROPERTY DAMAGE, ANY ACCIDENT, LOSS, INJURY OR DEATH, OCCURRING FROM HIS/HER PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY WAY RELATED TO THE PRIZE OR USE/MISUSE THEREOF.

Neither the Sponsor nor the Sponsor Affiliates make any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use of any Prize including, without limitation, quality, merchantability, or fitness for a particular purpose. Further, Sponsor accepts no responsibilities for any expenses, omissions, delays, re-routing, or acts of any government or authority relating to the Sweepstakes. 

SPONSOR IS NOT RESPONSIBLE FOR ERRORS IN THE ADMINISTRATION OR FULFILLMENT OF THIS SWEEPSTAKES, INCLUDING BUT NOT LIMITED TO, MECHANICAL, HUMAN, PRINTING, DISTRIBUTION OR PRODUCTION ERRORS, AND MAY MODIFY OR CANCEL THIS SWEEPSTAKES BASED UPON SUCH ERROR OR SUSPECTED ERROR AT ITS SOLE DISCRETION WITHOUT LIABILITY.

7. GENERAL: Entrants by their participation agree to be bound by these Official Rules.  Potential winners by their execution of Sponsor’s required releases, consent to the use of their name, image and likeness including without limitation their name, address (city, state) and photographs for purposes of advertising, trade and promotion in any and all media, whether now known or later developed, worldwide, in perpetuity, on behalf of the Sponsor, without further compensation except where prohibited by law. All taxes, costs, and other expenses related to the prize are solely the responsibility of the winner, including but not limited to, additional insurance or extended service plans which are not included in the prize as stated.  No prize substitution or transfer except by Sponsor, at Sponsor’s sole discretion, who reserves the right to substitute a prize (or portion thereof) with a prize of equal or greater value.

8.  ENTRIES: If for any reason this Sweepstakes is not capable of running as planned or there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes or if a computer virus, bug, unauthorized intervention, fraud, technical failure or any other cause corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process; and to cancel, terminate, modify or suspend the Sweepstakes; and to conduct a random drawing to award the prize from among all remaining eligible non-suspect entries received as of the date of termination. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Sponsor.. The Sponsor assumes no responsibility for the processing of entries including without limitation, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries or for the administration of the Sweepstakes or for the announcement of prizes or for information included in any Sweepstake related materials. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials of this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of any online entry based on an e-mail address, the entry will be declared to have been made by the Authorized Account Holder of the e-mail address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

9. WINNER’S LIST: To receive a winners’ list, mail a separate self-addressed, stamped envelope, by February 27, 2008 to: Kretschmar® "Super Savings. Legendary Taste." Sweepstakes Winners List, P.O. Box 14789, Cincinnati, OH 45250.
